Precedent Developments — Privacy Policy

Precedent Developments Inc. (“Precedent,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our websites, interact with our digital properties, apply for roles, or engage with us as an investor, client, vendor, or community member across Canada and the United States.

This policy is written to be on par with leading real estate development companies and designed to align with major privacy frameworks, including Canada’s PIPEDA and applicable provincial laws (e.g., Alberta PIPA), the EU/UK GDPR, and certain U.S. state laws (e.g., CCPA/CPRA). Where local law requires stricter protections, we apply them.

1) Scope & Who We Are

This Privacy Policy applies to personal information processed by Precedent through:

  • Our websites, landing pages, and microsites (collectively, the “Sites”);

  • Online forms (e.g., “Contact,” “Book a Consultation,” “Sign up for Investment Updates”);

  • Digital communications (email, SMS, social media), investor and client portals;

  • Events, site tours, and market research; and

  • Recruitment portals and supplier onboarding.

Controller: For most processing activities described here, Precedent is the “controller” (or equivalent) responsible for your personal information.

2) What We Collect

We collect information directly from you, automatically from your device, and from third parties.

A. Information You Provide

  • Identity & contact: name, email, phone, mailing address, company, role.

  • Project & inquiry details: property interests, development objectives, budgets, timelines, site constraints, and related documents you choose to share.

  • Investment preferences: accreditation status (where applicable), interest areas, risk tolerance, subscription choices.

  • Marketing preferences: newsletter opt-ins, event RSVPs, survey responses.

  • Job applicant data: résumé/CV, cover letter, work history, references, portfolio links, immigration/eligibility info as allowed by law.

  • Vendor & consultant data: business contact details, qualifications, insurance and compliance attestations.

B. Information Collected Automatically

  • Device & usage: IP address, device identifiers, browser type, operating system, language settings, referring URLs, pages viewed, links clicked, session dates/times, general location (derived from IP).

  • Cookies & similar tech: pixels, tags, SDKs, and local storage for core site functionality, analytics, and (where enabled) advertising measurement.

C. Information from Third Parties

  • Public and commercial sources: property records, market data, demographic indicators.

  • Marketing & analytics providers: audience insights, engagement metrics, campaign performance.

  • Recruitment platforms: professional profiles and credentials (subject to your settings).

We do not intentionally collect sensitive personal information (e.g., government identifiers, health data) through the Sites unless you choose to provide it and we have a clear purpose and legal basis to process it.

3) How We Use Personal Information

We use personal information to:

  • Operate and improve the Sites (including debugging, analytics, and personalization);

  • Respond to inquiries and provide proposals, feasibility reviews, and project updates;

  • Deliver marketing communications, newsletters, event invitations, and investor updates (you can opt out anytime);

  • Develop, market, and manage projects, including entitlement, design coordination, and tenant/investor relations;

  • Conduct research and due diligence for acquisitions and partnerships;

  • Administer events and community engagement activities;

  • Recruit and evaluate candidates;

  • Comply with law, enforce our terms, and protect our rights, users, and the public.

Legal bases (EEA/UK): consent (e.g., newsletters), contract performance (e.g., proposals), legitimate interests (e.g., improving services, ensuring security), legal obligations (e.g., record-keeping), and, where required, your explicit consent.

4) Cookies & Tracking Technologies

We use:

  • Essential cookies for security and core functionality;

  • Analytics cookies to understand usage and improve user experience;

  • Advertising/measurement cookies (where enabled) to assess campaign performance and, in some regions, to deliver or measure tailored content.

Your choices:

  • Use your browser settings to block or delete cookies.

  • Use platform opt-outs (e.g., Google/Meta/LinkedIn ad settings) and, where offered, our cookie banner controls.

  • If your browser sends a Global Privacy Control (GPC) signal, we will treat it as a request to opt out of “sale”/“sharing” where legally required.

Blocking certain cookies may impact site functionality.

5) Sharing & Disclosure

We may share personal information with:

  • Service providers / processors: hosting, CRM, email/SMS delivery, analytics, security, payment, recruiting, document management.

  • Professional advisors: law firms, auditors, insurers, consultants.

  • Project partners: co-developers, design/engineering consultants, brokers, lenders and investors (limited to what is necessary, pursuant to appropriate safeguards).

  • Business transfers: as part of a merger, acquisition, financing, or asset sale.

  • Legal & compliance: to comply with law, enforce terms, or protect rights, property, safety, and security.

We do not sell personal information for money. Where cross-context behavioral advertising could be deemed a “sale” or “share” under certain U.S. state laws, we honor applicable opt-outs.

6) International Data Transfers

We operate in Canada and the U.S. and may transfer personal information across borders. When required, we implement appropriate safeguards (e.g., Standard Contractual Clauses for EEA/UK data, contractual commitments with processors, and transfer risk assessments).

7) Retention

We retain personal information while we have a legitimate business need or legal obligation—considering the nature of the information, the purpose of processing, legal requirements, and security needs. When no longer needed, we take steps to securely delete or de-identify information.

8) Security

We employ administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. No system is perfectly secure; we encourage you to use unique passwords and to notify us promptly of any suspected account or data security issue.

9) Your Rights & Choices

Your rights depend on where you live. Subject to legal limits, you may have the right to access, correct, delete, or restrict processing of your personal information; to object to certain processing; to withdraw consent; and to data portability.

Canada (PIPEDA / Alberta PIPA)

  • Request access to, or correction of, your personal information.

  • Withdraw consent to marketing at any time.

  • File a complaint with the Office of the Privacy Commissioner of Canada (OPC) or, in Alberta, the Office of the Information and Privacy Commissioner (OIPC) if you believe your rights were infringed.

EEA/UK (GDPR/UK GDPR)

  • Rights include access, rectification, erasure, restriction, portability, and objection to processing (including profiling based on legitimate interests or direct marketing).

  • You may lodge a complaint with your local Data Protection Authority.

United States (Selected State Laws, incl. CA)

In certain states (e.g., California, Virginia, Colorado, Connecticut, Utah), you may have rights to:

  • Know/Access categories and specific pieces of personal information we collected about you;

  • Delete personal information;

  • Correct inaccurate personal information;

  • Opt out of targeted advertising and certain profiling; and

  • Opt out of “sale” or “sharing” of personal information (as defined by law).

We do not knowingly “sell” personal information for money. Where our use of advertising cookies/pixels may be considered a “share” or “sale” under California law, you can opt out by using cookie preferences and/or sending a GPC signal. If we deny your request, some states allow you to appeal; instructions will be included in our response.

How to exercise rights: See Contact Us below. We will verify your identity before responding. You may use an authorized agent subject to verification and documentation requirements.

10) Children’s Privacy

Our Sites are not directed to children, and we do not knowingly collect personal information from individuals under the age of 13 (or the age required by local law). If you believe a child has provided us personal information, please contact us and we will take appropriate steps to delete it.

11) Third-Party Links, Tools, & Social Features

Our Sites may include links to third-party websites, embedded maps, booking tools, or social media widgets. These third parties operate independently and have their own privacy practices. Review their policies, as we are not responsible for their content or handling of personal information.

12) Automated Decision-Making & Profiling

We do not engage in automated decision-making that produces legal or similarly significant effects about you. We may use limited profiling for analytics or to tailor communications, subject to your rights and applicable law.

13) Investor Updates & Marketing Communications

If you subscribe to investment updates, newsletters, or event invitations, we’ll use your contact details to send those communications. You may unsubscribe at any time via the email link or by contacting us. Even if you opt out of marketing, we may still send non-promotional messages (e.g., transactional or service-related).

14) California “Notice at Collection”

Categories we collect (examples):

  • Identifiers (name, email, phone);

  • Commercial information (inquiry type, services requested);

  • Internet/Network activity (usage analytics, device data);

  • Professional information (role, company);

  • Geolocation data (coarse location from IP).

Purposes: As described in Section 3.
Sources: You, your devices, and third-party providers (Section 2).
Retention: See Section 7.
Disclosure: We disclose these categories to service providers and, where necessary, partners as described in Section 5.
Sale/Share: We do not sell personal information for money. Certain advertising/analytics activities may be deemed a “share.” You can opt out via cookie settings and GPC signals.

15) Changes to This Policy

We may update this Privacy Policy from time to time. The “Effective date” above reflects the latest revision. Material changes will be posted on the Sites (and notified where legally required).

17) Supplemental Disclosures for Job Applicants & Vendors

Applicants: We process your application materials to evaluate suitability, manage interviews, conduct reference checks, and, where permitted, verify credentials. If hired, your information will be handled under our internal employee privacy policies.
Vendors/Consultants: We process business contact data, qualifications, compliance and insurance information, banking details for payments, and related records for onboarding, contract performance, and due diligence.
